Ordinance No. 25-2 An Ordinance Regulating the Burning of Materials in the Town of Damascus, Arkansas Be it ordained by the Town Council of Damascus, Arkansas: Section I. Purpose The purpose of this ordinance is to protect the health, safety, and welfare of the residents of Damascus by regulating the burning of materials, prohibiting the burning of hazardous materials, and requiring permits for prescribed burning. Section 2. Definitions
Section 4. Requirement for Burn Permits (a) No prescribed burning of materials shall be conducted without obtaining a burn permit from the Town of Damascus. (b) Burn permits may be approved or denied by the Damascus Fire Chief or his/her designee, based on an assessment of safety conditions and compliance with this ordinance. (c) The permit holder must comply with all conditions specified in the permit, including safety measures and restrictions on the type of materials to be burned. Section 5. Safety Standards for Prescribed Burning (a) All prescribed burning shall be conducted during daylight hours only, unless otherwise approved. (b) Burning shall not occur on days with wind speeds exceeding 15 miles per hour or during periods of a countyissued burn ban. (c) Fires must be attended at all times by a responsible adult and means to extinguish the fire must be readily available. (d) Burning shall be conducted at least 25 feet away from any structure, or improvements, or property line. Section 6. Penalties for Violations (a) Any person found in violation of this ordinance shall be subject to fines not exceeding $500 per offense. (b) Repeat offenders may face additional penalties, including revocation of burn permit privileges. Section 7. Emergency Clause It is hereby found and determined that the burning of hazardous materials poses an immediate threat to public health and safety. Therefore, this ordinance shall take effect immediately upon its passage and approval. APPROVED AND ADOPTED by the TOWN COUNCIL of DAMASCUS, ARKANSAS, this _13th day of May,2025. |
